En este ensayo, más que un juego lingüístico de términos y expresiones, se tratara de enfatizar los términos vida humana y persona humana, como estos de la simple sinonimia en la conversación habitual, han sido trastocados en sofisticado instrumento jurídico, al concluir en Costa Rica la Sala Constitucional, por quien sabe que ciencia infusa, que el embrión recién fecundado ya es persona. Por tanto se enfatiza con fuerza el contrasentido de aseverar que el principio y el producto son lo mismo, entendiendo que la semilla es diferente al fruto, citando a Savater, cuando dijo que el que come un huevo no ha comido pollo. El embrión recién fecundado o pre-embrión, es principio, semilla, potencia, quizás un día sea persona, de ahí la conclusión de que no toda vida humana es persona humana.

In this essay, more than a linguistic game of terms and expressions, we treat the meanings of human life and the human person, and how this simooms in the habitual language, have been to changed into a sophisticated judicial tool, by the conclusion of the Costa Rican Constitutional Court, who using a mysterious science, has said that once the ovule has been fecund, it is a human being. For that reason we emphasize the contra sense to sever that the beginning is the same than the product, understanding that the seed is different than the fruit, referring to Savater, when he said, when you eat an egg you are not eat chicken. The embryo recently fecund or pre-embryo is beginning, seed, potency, maybe one day it will be a human person, from there the conclusion that not all human life is a human person.

Las técnicas de reproducción humana asistida, y entre ellas la fecundación in vitro (FIV), suscitan interrogantes éticas. Su empleo promete beneficios para la humanidad y, específicamente para parejas infértiles la satisfacción de ser madres y padres. En este artículo se propone que la fe cristiana ha de afirmar la legitimidad ética de la FIV, ésta con base en los valores fundantes de la fe como la misericordia, la justicia, el bienestar, el amor y el compromiso con los necesitados que practicó Jesucristo. Se argumenta que la FIV es una técnica que promueve la vida y la dignidad humanas. Además se propone que la ética se entiende mejor no en términos deontológicos, sino contextuales que responden a situaciones reales de la vida, específicamente una ética de la responsabilidad.

The techniques of assisted human reproduction, among them in vitro fertilization (IVF), raise ethical questions. Their use promises benefits for humanity and, specifically for infertile couples, the satisfaction of being parents. This article proposes that Christian faith affirms the ethical legitimacy of IVF based on the founding values of mercy, justice, well-being, love, and commitment to the needy as practiced by Jesus Christ. lt is argued that IVF promotes human life and dignity. In addition, it is proposed that ethics is best understood not in deontological terms, but rather in terms of contexts that respond to real life situations, specifically an ethics of responsibility.

Las técnicas de reproducción asistida, y entre ellas la clonación humana, suscitan interrogantes éticas. Su empleo promete beneficios para la humanidad y, específicamente para parejas infértiles la satisfacción de ser madres y padres. En este artículo se debaten las regulaciones y las implicaciones jurídicas de dicha actividad, actualizándonos en el acontecer mundial y nacional del tema. Se argumenta que la clonación humana ya es una realidad y como si esta técnica se regula promueve la vida y la dignidad humanas. Además se propone que esta técnica se entiende mejor no en términos moralistas, sino contextuales que responden a situaciones reales de la vida, específicamente una ética de la responsabilidad.

Las técnicas de reproducción humana asistida, la biotecnología y la pericia médica actual nos tienen en capacidad de decidir cuando un niño nacerá con defectos congénitos. En tales casos se ha llegado a considerar el derecho a indemnizar a los niños (por medio de sus padres) por haber nacido así como consecuencia de una mala praxis médica. En este artículo se compararán otros ordenamientos jurídicos con el costarricense el cual presenta una situación absolutamente peculiar, que hace aplicables y legales algunas "curiosas" situaciones, como el feto que es persona, pueda exigir el pago con la novedad no de la indemnización, sino del medio que usa.

The techniques of assisted humor, reproduction, biotechnology and the modern medical expertise give us the capacity to decide when a child is going to be born with congenital defects. In these cases, it has been considered a right for the child, to be paid (trough his parents) for the way he was born, consequence of a medical mal praxis. In this essay we compare other juridical ordainments with the Costa Rican, which has an exclusive peculiar situation, that makes it possible to apply and legalize some "curios" situations, like the fetus as a person, with the novelty of the way he can demand the payment.

Las técnicas de reproducción asistida: fecundación in vitro, y transferencia de embriones, han sido declaradas inconstitucionales en Costa Rica por la Sala IV, aduciendo que la vida humana comienza con la fecundación negando el concepto de pre-embrión, haciendo que desde el punto de vista técnico, esta posición sea incorrecta, pues confunde los conceptos de fecundación con el de concepción como si se distingue y establece en las convenciones internacionales de derechos, siendo también contrario al criterio médico y médico legal.

The techniques of assisted reproduction: in vitro fecundation, and embryo transfer, have been declared unconstitutional in Costa Rica by the Constitutional Court, adducing that human life begins with the fecundation meaning that the concept of pre-embryo does not exist, which makes the technical point of view incorrect, because it confuses the concepts of fecundation and conception; which are well distinguish in the internacional rights conventions, and also contradicting medical and forensic criteria.

El voto 2306-2000 (sobre la fecundación in vitro) de la Sala Constitucional, ha dado un giro "copernicano" al concepto de "persona" y la protección que a ellas se les ofrece, en el campo jurídico. La Sala generalizó el uso de la palabra "persona" a todos los seres humanos ya nacidos y a "no nacidos" llamados en nuestra legislación "fetos". Tal definición, modifica de plano el Código Civil que expresa: "La existencia de lapersonafisicaprincipia al nacer viva... "y con ello, toda la aplicación de la materia no solo civil sino también la de Derecho de Familia, al otorgarle una serie de derechos y obligaciones a esta categoría de seres humanos (los no nacidos) que antes no les ofrecía.

The 2306-2006 vote of the Costa Rican Constitutional Court ( about the in vitro fecundation), has made "Copernicans" revolution on the concept of "human person" and the legal protection given to them. The Court spread the use of the word "human person" to every human being including the unborn, called in our legislation, "fetus". This definition modified the Civil Code which expresses " The existence of the human person are begins at a living birth" and affects as well the Family Code because the rights and obligations now given to the unborn.

Si bien la interrupción voluntaria del embarazo es una práctica común en todo el mundo, el tema es sumamente controversias ya que en él se conjugan aspectos fundamentales como el inicio de la vida humana, el derecho de las mujeres a controlar su propio cuerpo, la sexualidad, la naturaleza de las responsabilidades del Estado para interferir en este terreno y las tensiones entre las visiones seculares y religiosas sobre la vida. El debate permite precisamente visibilizar el hecho de que sobre estos temas no existen visiones homogéneas e inmutables. En ese sentido, a pesar de que en muchos países existen leyes que penalizan el aborto, el asunto nos remite al terreno de principios morales y éticos contrapuestos. Aquí se discuten algunas de las implicaciones de estas controversias y se brinda información sobre la incidencia del aborto, así como sobre las consecuencias tanto del aborto inseguro como de la despenalización. Finalmente, se analizan las implicaciones de la penalización del aborto para el cumplimiento de algunos derechos fundamentales como el respeto a las diferencias, la libre elección, la autodeterminación y la tolerancia.

Although abortion is commonly practiced throughout the world, it is a subject that arouses controversy because it raises fundamental questions about human existence, such as when life begins, the right of women to control their own bodies, sexuality, the nature of the State's duties in this matter, and the tension between secular and religious views of human life. This debate allows to make visible the fact that there are no homogencous or unchanging views on these subjects. In that sense, although in many countries the practice of abortion is iIlegal, the issue remits us more to the level of moral and ethical principles. In this article we discuss some of the implications of these controversies and provide information about the incidence of abortion, as well as of the consequences of both unsafe abortion and legalization of the practice. Finally, we analyze the implications of the laws that criminalize abortion on behalf of the fulfillment of some fundamental rights, such as the respect to differences, freedom of choice, self-determination and tolerance.

Una de las valoraciones médico forenses difíciles de realizar en una forma precisa, clara y justa, es la dirigida a dictaminar si una persona está inválida. Muchas veces el perito, al no contar con un esquema o marco conceptual idóneo, produce un dictamen que no es otra cosa que una enumeración de datos inconexos, a veces incoherentes y contradictorios. Ha sido nuestra preocupación, después de varios años de estudiar dictámenes en los que se hace dicha peritación, luego de extensas conversaciones con mis compañeros de la Sección A del Consejo Médico Forense, aportar un marco conceptual, que permita hacer el análisis de estos casos, con mayor apego a la realidad clínica de los trabajadores que solicitan una pensión por invalidez. Porque de otra forma se hacen las valoraciones a "ojo de buen cubero" o "al cálculo", la mayoría de las veces con opiniones -que no criterios-, derivadas de prejuicios, estereotipos y experiencias personales anecdóticas. Aunque el marco conceptual es fundamental, es importante mencionar que la corrección y el valor de las operaciones médico-legales no dependen solamente de los métodos y técnicas puestos en práctica, sino de las cualidades intelectuales y morales del perito. Este artículo va dirigido a los residentes especialmente y a todas las personas de buena voluntad y sólo quisiera que sirva de estímulo a la reflexión sobre este tema, que es de gran importancia, en mi criterio.

One of de most difficult evaluations that a forensic doctor carries out is the one which determines, in a precise clear andjust way, whether or not a person is a handicap. Many times, the expert not having an out line or a suitable frame of reference, produces a veredict that is nothing bur an enumeration of incoherent, contradictory and incongruent information. lt has been our concern, after many years of studying veredicts of such kind, after long and extensive conversations with my colleages of section A of the Forensic Medical counsil, to contribute with a fragme or reference qhich will allow these cases lo be analyzed with a greater closeness to the clinical reality of the patients who request a pension por disability. In any other way, the evaluations are made by mere calculations, most of the time with opinions (and not criteria) deduced front prejudices, stercootypes and personal anecdotic situacions. Altrough the frame or reference is fundamental. It is important to mention that the correction and the vacue of medical-legal operations doesn't depend onlv on the methods and technicoves employed, but also on the moral and intellectual qualities of the expert, This article is dedicated especially lo the residents and to all good-willed people, and I would only want it to stimulate thinking on this topic wich in my opinion, is of extreme important.

La ideología engendra cierto número de mitos destinados a polarizar la afectividad, la solidaridad "comunitaria" o "nacional", la evasión respecto a la realidad y la visión irracional del mundo. La ideología nazi sobre la superioridad de la raza aria inspiró particulares políticas de investigación médica con seres humanos vivos, generando a posteriori un proceso jurídico que culminó con el establecimiento de principios esenciales para la protección de las personas participantes en tales investigaciones. A pesar de las actuales regulaciones para este tipo de experimentos, subsisten desigualdades que generan injusticias, lo que es posible evitar empleando criterios estrechamente vinculados a las perspectivas de género.

Ideologies help develop myths destined to polarize our affections, solidarity (national or community), evasion of reality and irracional world vision. The Nazi ideology of superiority inspired medical researches in living human beings, generating this way an a posteriori juridical process that established the essential principles of protection of the peoples participating in those researches. Ignoring the actual regulations for this type of experimentation, there are, still today, differences that generate injustice, which is possible to avoid using criteria strictly related to genre perspectives.

En Costa Rica se llevan a cabo investigaciones clínicas en los servicios asistenciales de la Caja Costarricense del Seguro Social, sin cumplirse con los requisitos establecidos en nuestro ordenamiento jurídico. Así, debe revisarse la regulación existente sobre el factor indemnizatorio que los participantes de la investigación clínica -patrocinador, investigador, institución pública o privada- deben cumplir y observar como elemento configurante del consentimiento informado, de forma tal que no se lleve a cabo la investigación si no se cuenta con una póliza obligatoria por parte de los promoventes, que cubra las diversas eventualidades de lesión y muerte del sujeto a experimentación.

In Costa Rica, several clinic investigations have taken place in the medical services of the Social Security without filling the requirements that our legal system establishes. lt is necessary that the regulation of the indemnizatory factor that the people involved in the investigation, like the host, investigator, public or private institutions, have to fulfill and regard, as a configuring element, the acknowledged. information, in a way that the investigation cannot be made if they do not give the respective accountability to pay for eventual mistakes, lesions and ever death of the subject of the investigation.

Las investigaciones sobre diversos casos de experimentación indebida en seres humanos en los hospitales de la Seguridad Social, elaboradas el siglo pasado, por la Asamblea Legislativa y por el Ministerio Público y la Auditoría de la CCSS, en los años recientes, no han permitido responsabilizar penalmente a sujeto alguno, ni trazar una política pública en este campo. Es indispensable que se apruebe una reforma normativa que tipifique estas graves conductas y así lo propongo.

The investigations of diverse cases of experimentation in human beings at the Social Security Hospitals, which took place by the Legislative Assembly, the Public Ministry and the CCSS Auditory, in the last few years, has not been penalizad and it is not allowed to trace a public policy in this field. My proposal is that it is very important to approve a normative reform that typifies these harmful behaviors.

La investigación clínica en seres humanos actualmente ha generado un gran debate a nivel mundial. Costa Rica se encuentra inmersa en esta vorágine; país líder en sus propias investigaciones y sede de compañías transnacionales. Pero ¿qué sucede con la propiedad intelectual de los resultados de las mismas?. Un breve análisis del Reglamento para la investigación clínica en los servicios asistenciales de la CCSS, confirma un evidente andamiaje para que compañías privadas nacionales o empresas extranjeras, hagan sus investigaciones y se marchen con el resultado, con el fin de patentarlos en otros países y obtener los beneficios económicos propios de esta actividad que desarrollaron aquí.

The clinic researches in human at this moment have generate a great debate, worldwide. Costa Rica is immersed into this world wide situation, being a country leader in its investigations and a house for many transnational companies. But, what happens with the intellectual property of these researches? By analyzing the actual regulations of the CCSS for clinic research, it is clear that national and forcign companies are allowed to make researches in our country and then go with the results to patent them in other countries and obtain the economic advantages proper of the activity developed here.

En nuestro país, se prohibe investigar con fines no terapéuticos en menores de edad, pero igual sucede. La niñez debe ser incluida en los estudios clínicos de un medicamento, únicamente cuando le ofrezca beneficios potenciales, excepto que su vida, integridad, dignidad o salud estén en juego. Los estudios clínicos no prevén un mecanismo estricto para la obtención del consentimiento informado. Ningún representante puede decidir sobre la vida, integridad y salud del niño a su cargo, que le pueda ocasionar un perjuicio. El niño no recibe información sobre la investigación que se le va a hacer y mucho menos se toma su parecer, obviándose sus derechos fundamentales.

In our country it is forbidden to investigate with non therapeutical means in children under age, although it happens anyway. Children can be included in clinical studies of treatments, only when the research offers potential benefits to them; the only exception is that his life, health or integrity are in danger. These clinical investigations do not follow a certain method of obtaining acknowledged information. No representative can decide over the life, integrity or health of the child in his/her charge. The child is not informed about the investigation he/she will be submitted to, neither will his/her point of view is taken into consideration; thus, ignoring fundamental rights of the young people.

La inclusión de este manual basa su fundamento en la necesidad de que los profesionales médicos y juristas conozcan lo concerniente a toda revisión corporal de personas privadas de libertad, ya que debe respetarse su pudor. Para estos efectos, la revisión de mujeres debe ser realizada por personal femenino, en el caso de los varones por personal masculino. Cuando el detenido asuma una posición hostil o agresiva ante el servidor que procura la revisión corporal, debe recurriese en primera instancia al diálogo y la persuasión, y si se utilizará la fuerza que sea estrictamente la necesaria para poder realizar la diligencia, para lo cual se podrá hacer uso de los instrumentos de seguridad, como la vara policial, el dispositivo de esposas y cualquier otro autorizado por la Institución.

The inclusion of this manual has its base in the need that professionals in medicine and law acquire the knowledge concerning general check ups of the people who are in jail, because their integrity must be respected. For these effects, women have been checked by female personnel and the men, by male personnel. When the detained person assumes an aggressive or hostile position with the evaluator, the first thing to do is use dialogue and persuasion. Force can be used when it is strictly necessary to carry out the diligence, using security instruments, such as the police stick, handcuffs and others' allowed by the Institution.
