En esta investigación se plantea el problema desde la óptica de la necesidad pericial que tiene el estado costarricense y como podría cambiar la prestación de servicios ante la aprobación de los tratados de libre comercio con otras naciones conocidos comúnmente como TLC si se promueve la privatización de las pericias médico legales, lo que plantea una interrogante seria ¿Cuál sería el impacto social en el caso de que se privatizaran las pericias médico legales? Ademas se cuestionan los siguientes asuntos ¿cómo garantizar la cadena de custodia con la privatización de las pericias médico legales y cuáles deben ser las funciones del Departamento de Medicina Legal?

In this investigation the issue is stated from the expertise necessity’s point of view that the Costa Rican state has and how would it change the rendering of services before the approval of free commerce trades with other countries, known as TLC, if a privatization of the medical legal expertise is promoted, which implies a serious question: what would be the social impact en case that the medical legal expertise is privatized? Also it would be questioned the following matters: how to guarantee the custody chain with the privatization of the medical legal expertise and which have to be the functions of the Legal Medicine Department?

La presente investigación se basa en los análisis de el acuerdo de Corte Plena y Consejo Superior junto con el análisis de las entrevistas quienes analizan desde dos ópticas la función en alzada del Consejo Médico Forense y estas son: beneficios y perjuicios de su eliminación. Se consideran además aspectos históricos del Consejo Médico Forense y sus funciones actuales.

This investigation is based on the analyses of the agree between the Supreme Court and the Superior Council as long with the analysis of the interviews of those who study the function of the Medical Forensic Council from two points of view: benefits and damages of its elimination. Historical aspects and current functions of this Council are also considered.

En este ensayo se revisa el deterioro hostil, en el Salvador y en Costa Rica, que ha llegado hasta las instituciones penitenciarias caracterizándose por hacinamiento que se traduce en limitación para la satisfacción de muchas necesidades, las cuales se abordan y correlacionan con la violencia intra carcelaria que va desde el abuso físico, emocional o sexual hasta el suicidio u homicidio. La cárcel es un medio agresivo para el individuo, por lo que se analiza como implementar las reglas mínimas que aseguren los derechos al Privado de Libertad. En este ensayo comparativo se considera el rol del médico de cárceles entre ellos el Médico Forense, y su deber de velar por la salud del privado de libertad y de los Derechos Humanos Universales, además se procura ganar un espacio dentro de la sociedad ofreciendo la oportunidad para reflexionar sobre la exigencia de esta temática.

In this essay it is checked the hostile decay, in El Salvador and Costa Rica, that has reached the penitentiary institutions and that is characterized by the heaping which leads to a limitation of the satisfaction of many needs, that are treated and correlated with violence within the jail that goes from physical, emotional or sexual abuse up to suicide or homicide. Prison is an aggressive environment for the individual, that’s why it is analyzed how to put in practice minimum rules that can assure that the rights for the imprisoned. Inn this comparative essay it is considered the role of the prison’s doctor, also of the forensic doctor and their duty to guard the depriver’s health and the Universal Human Rights, as well is intended to fill a spot inside society offering the opportunity to think about this topic.

El presente trabajo de investigación sobre la revictimiación institucional pone de manifiesto la existencia de dicho fenómeno dentro del sistema judicial. Se analizan las causas de esta situación la cual aparenta no tener la debida cobertura del sistema ni la de los propios funcionarios que laboran en tal situación. Se hace una exposición de motivos que explica el fenómeno que incluye las políticas existentes, las estrategias de capacitación, difusión y consistencia. Además se estudia la existencia de la Oficina de Atención a la Víctima del Delito desde su iniciativa, la cual catapulta la figura de la víctima a un lugar hasta entonces negado, sin que su actuar trascienda al ámbito requerido por razones que se analizan. En las conclusiones se brindan recomendaciones pertinentes para quienes están sufriendo como victimas por su labor.

This investigation about institutional revictimization demonstrates the existence of this phenomenon within the judicial system. The causes of this situation are analyzed, that seems not to have the appropriate coverage from the system nor from the employees of the institutions. An exposition of the different motives is done to explain the phenomenon that includes current policies, capacitating strategies, diffusion and consistency. Also the existence of the Attention to Victim of Crime Office is studied from its initiative, which catapults the victim figure to a previously denied place. As conclusions, some recommendations are brought for those who are suffering as victims.
